الملخص (Abstract)

باللغة العربية: جاءت هذه الدراسة لتبين قاعدة "مقدمة الواجب" وما لها من أثر في المحافظة على أحد المقاصد الضرورية وهي حفظ النفس من مخاطر فيروس كورونا. تناولت الدراسة مفهوم القاعدة وأقسامها، وأهميتها وحكمها، وعلاقتها بالمقاصد والوسائل، ثم أثرها في المحافظة على النفس من خلال تطبيقاتها المعاصرة المتعلقة بفيروس كورونا. استخدم الباحث المناهج الاستقرائية والتحليلية والوصفية، إضافة إلى الجانب التأصيلي، وخلصت الدراسة إلى عدة نتائج أهمها: أن مقدمة الواجب هي ما يتوقف عليها وجود الواجب (فعلاً أو تركاً)، وأن القاعدة تظهر أهميتها في التمييز بين المقدمات المعينة على الواجبات والمقدمات المفضية للمنكرات. كما خلصت إلى أن لولي الأمر اتخاذ الإجراءات الوقائية (كالحجر الصحي، ومنع التجوال، وتعليق الجمع والجماعة) باعتبارها مقدمات ووسائل لتحصيل واجب حفظ النفس من الهلاك.

باللغة الإنجليزية: This study aims to clarify the rule of "the prerequisite of duty" (muqaddimat al-wajib) and its impact on preserving one of the essential objectives (Maqasid), which is safeguarding human life from the dangers of the Coronavirus (COVID-19). The study addressed the concept, divisions, importance, and ruling of this rule, as well as its relationship with objectives (Maqasid) and means (Wasa'il). Furthermore, it analyzed its impact on preserving life through contemporary applications related to the pandemic. The researcher employed inductive, analytical, and descriptive methodologies, in addition to the foundational (ta'sili) aspect. The study concluded with several results, most notably: that the "prerequisite of duty" refers to what the existence of the duty depends upon (both action and omission), and that the rule is significant in distinguishing between prerequisites that facilitate duties and those that lead to prohibited acts. The study also concluded that the ruler (Wali al-Amr) is authorized to take necessary preventive measures (such as quarantine, curfews, and suspending Friday and congregational prayers) as these serve as prerequisites and means to achieve the mandatory objective of safeguarding life from destruction.
