الإجماع بين النص والاختلاف الفقهي (دراسة نظرية تطبيقية)

الملخص

• الملخص (عربي): يستهدف هذا البحث دراسة أسباب الاختلاف الفقهي المترتب على اختلاف النص والإجماع ظاهريا، وهي أحد أسس دفع التعارض بينهما، وتوصلت هذه الدراسة إلى أن الإجماع الذي يتم التوفيق بينه وبين النصوص الشرعية، هو الإجماع الحقيقي وليس المدعى، وضرورة فهم النصوص فهما دقيقا، لما لذلك من أهمية في الوقوف على المعنى الصحيح، ولما يترتب على ذلك من أحكام شرعية، كوجوب كفارة أو عدمها. ومن هذا المنطلق جاء هذا البحث ليقدم دراسة نظرية تطبيقية موجزة، أستهل بالمبحث الأول في مفهوم النص والإجماع والاختلاف الفقهي، وجاء المبحث الثاني في أسباب الاختلاف الفقهي، وأما المبحث الثالث فجاء تطبيقا بالأمثلة للإجماع بين النص والاختلاف الفقهي.

• Abstract (English - ترجمة للملخص): This research aims to study the causes of jurisprudential disagreement resulting from the apparent discrepancy between texts and consensus, which is one of the foundations for resolving conflicts between them. The study concluded that the consensus that is reconciled with legal texts is the true consensus, not the claimed one, and emphasized the necessity of understanding texts precisely due to its importance in determining the correct meaning and the resulting legal rulings, such as the obligation of expiation or otherwise. Accordingly, this research provides a concise theoretical and practical study. The first chapter covers the concepts of text, consensus, and jurisprudential disagreement, the second chapter discusses the causes of jurisprudential disagreement, and the third chapter applies these concepts through examples of consensus between text and jurisprudential disagreement.
