صيغة الأمر في اللغة ودلالته عند الأصوليين

حاول هذا البحث بيان صيغة الأمر عند الأصوليين، وما تدل عليه من معانٍ لغوية وأحكام شرعية. فالأصوليون اختلفوا بشأن مسائل الأمر؛ فمنهم من نازع في وجود صيغة الأمر، ومنهم من أثبتها. ثم نظر الأصوليون في المعاني اللغوية التي تدل عليها هذه الصيغة، وتوسعت الآراء في ذلك لتصل عند البعض إلى ما يزيد على ثلاثين معنى. أما في دلالة الأمر على الأحكام فقد اختلفوا أيضاً، فمنهم من قصرها على الوجوب، ومنهم على الندب أو الإباحة، ومنهم من جعلها مشتركة، ومنهم من توقف حتى ترد القرينة. وقد تم بحث هذه الأمور في مقدمة ومبحثين وخاتمة

Abstract (English)

This research attempted to explain the expression of the command pattern among the fundamentalists, and the meaning of language and the legal verdicts. Fundamentalists have disagreed on these issues, some of them who disputed the existence of the same command pattern, and some of them proved it. The fundamentalists considered the linguistic meanings indicated by this pattern, some of them limited it to only two, and some expanded until it reached over thirty meanings. As for the significance of the command, the fundamentalists also disagreed. Some of them limited this indication to the rule of duty only, and some of them limited or accepted it, some made it common between these mandatory provisions, and some chose to stop in this indication until the context indicates the expressed meaning. All of these issues were discussed and recorded in the research plan consisting of an introduction, two chapters, and a conclusion.
