إمكانية التقاضي الإلكتروني في اليمن

الملخص

(الملخص):

"يستهدف هذا البحث دراسة نظام التقاضي الإلكتروني بوصفه أحد مظاهر التحول الرقمي في مجال العدالة، مع التركيز على مدى إمكانية تطبيقه في الجمهورية اليمنية. وقد اعتمد الباحث على المنهج الوصفي التحليلي لتحليل النصوص القانونية اليمنية ذات الصلة، واستقراء الواقع العملي للمحاكم اليمنية من حيث جاهزيتها التقنية والتنظيمية. وخلص البحث إلى عدد من النتائج والتوصيات، أهمها أن تطبيق نظام التقاضي الإلكتروني في اليمن يواجه تحديات تشريعية وفنية متعددة تتمثل في غياب الإطار القانوني المنظم لهذا النظام، وضعف البنية التحتية الرقمية وضعف البنية التحتية الخدمية، فضلاً عن محدودية الوعي المؤسسي بأهميته. كما أوصى البحث بضرورة تحديث التشريعات الإجرائية، وإعداد بيئة تقنية آمنة تدعم هذا التحول الرقمي."

(ABSTRACT):

"This research aims to study the electronic litigation system as one of the manifestations of digital transformation in the field of justice, with a focus on the possibility of its application in the Republic of Yemen. The researcher relied on the descriptive-analytical approach to analyze the relevant Yemeni legal texts and to extrapolate the practical reality of Yemeni courts in terms of their technical and organizational readiness. The research concluded with a number of results and recommendations, the most important of which is that the application of the electronic litigation system in Yemen faces multiple legislative and technical challenges represented in the absence of a legal framework regulating this system, the weakness of the digital infrastructure and the weakness of the service infrastructure, as well as the limited institutional awareness of its importance. The research also recommended the necessity of updating procedural legislation and preparing a secure technical environment that supports this digital transformation."
