Abstract
This research addresses the study and analysis of the foundational legal maxims (Al-Qawa'id Al-Usooliyyah) derived from the judicial letter of Umar ibn Al-Khattab (may Allah be pleased with him). The study comprises an introduction, two main sections, and a conclusion.
-
The Introduction includes definitions of the terms in the title, as well as the text of Umar's judicial letter.
-
The First Section is dedicated to discussing the two principles of obligation (Al-Ijab) and acting upon outward appearances (Al-Amal bi Al-Zahir), divided into three subsections.
-
The Second Section focuses on the principles of analogy (Al-Qiyas) and independent juristic reasoning (Al-Ijtihad), also divided into three subsections.
The research concludes with a summary of the most significant findings and recommendations. Among the key findings are:
-
The origin of the rules and rulings contained in the Umari letter traces back to the Qur'an and the Prophetic Sunnah.
-
Establishing a judicial authority is an obligation (Fard) and a duty incumbent upon the ruler, while the act of assuming judgeship itself revolves around the five legal rulings (Al-Ahkam Al-Taklifiyyah Al-Khamsah).
-
The letter provides evidence for the legitimacy of Ijtihad, the general application of analogy (Al-Qiyas), and specifically the analogy of resemblance (Qiyas Al-Shabah), where no explicit textual evidence (Nass) exists.
-
It emphasizes the obligation of acting based on outward appearances rather than hidden motives (Al-Bawatin).
